GENERAL TERMS AND CONDITIONS OF USE AND SALE OF THE MONDIAL TV SERVICE (T&C)

PREAMBLE

These General Terms and Conditions of Use and Sale (hereinafter "T&C") govern the contractual relationship between:

MONDIAL TV, a Simplified Joint-Stock Company (SAS) with a share capital of 30,000 euros, registered with the Créteil Trade and Companies Registry under number 841 047 905, with its registered office at 14-16 avenue Louison Bobet, 94120 Fontenay-sous-Bois (France), represented by its President Mr Sébastien Bachellier, (hereinafter referred to as "Mondial TV" or "the Company"),

and any adult natural person or legal entity, residing in mainland France or in a territory where the service is authorised, wishing to subscribe to the audiovisual broadcasting service of Mondial TV (hereinafter "the Subscriber" or "the Client").

The company MONDIAL TV handles the marketing and management of the TV CHANNEL Subscription.

These general terms and conditions of use and sale govern exclusively the MONDIAL TV+ offer. These conditions apply to the exclusion of all others, particularly those in force for other free services offered by the website.

These general terms and conditions of use and sale are intended to define the contractual and commercial relationship between MONDIAL TV, on the one hand, and any subscriber to the MONDIAL TV Service (hereinafter referred to as "the Subscriber"), on the other hand.

  1. Key definitions

For the purposes of these T&C, the following terms shall have the following meanings:

  • "Mondial TV Service": refers to the audiovisual platform operated by MONDIAL TV, accessible via the website https://mondial.tv, the mobile applications (Android / iOS) and compatible Smart TVs. It enables the streaming of television channels, replays, on-demand programmes (VOD) and exclusive content.
  • "Mondial TV Application": refers to the software published by Mondial TV available on official stores (Google Play Store, Apple App Store), providing access to the Service on smartphone, tablet or connected television.
  • "WebTV": refers to the online version of the Service accessible via an Internet browser on the official website.
  • "Subscriber": refers to any natural or legal person who has subscribed to a paid subscription to the Mondial TV Service.
  • "User Account": refers to the personal space accessible after registration and authentication, allowing the Subscriber to manage their information, subscription, payments and connected devices.
  • "Mondial TV Stick": refers to the optional hardware device offered for sale by Mondial TV (dongle or multimedia box allowing access to the Service via a television).
  • "Durable medium": refers to any means allowing the Subscriber to durably store contractual information (PDF, email, paper document).
  1. Purpose of the contract

These T&C are intended to define the conditions under which Mondial TV provides its subscribers with access to the online television and video-on-demand service, as well as the reciprocal rights and obligations of the parties in the context of the subscription, use and cancellation of the Service.

They govern all subscription methods:

  • online (via the website or official apps),
  • remotely (by telephone or commercial contact),
  • and off-premises (field sales or in-person canvassing).
  1. Scope of application

These terms apply to all use of the Mondial TV Service as well as to any paid subscription, regardless of the channel.

Any use of the Service implies full and complete acceptance of these T&C, which prevail over any other document or condition not expressly validated by Mondial TV.

Mondial TV reserves the right to modify these T&C at any time. New versions will apply from their publication on the website https://mondial.tv and after notification to the Subscriber in accordance with Article 12 hereof.

  1. Acceptance of terms

The Subscriber acknowledges having read and accepted without reservation:

  • these T&C,
  • the Privacy Policy and the GDPR Charter accessible on the official website,
  • as well as any special conditions that may apply to certain promotional offers.

Electronic acceptance (checkbox during subscription, validation click or signature on a durable medium) has the same legal value as a handwritten signature.

ARTICLE 1 – PURPOSE AND DESCRIPTION OF THE SERVICE

1.1 General overview of the Mondial TV OTT/IPTV service

MONDIAL TV is a television and video-on-demand service accessible via the Internet, operating using OTT (Over-The-Top) technology, meaning no set-top box or proprietary box is required. The service allows the Subscriber to access, via legal and secure streaming, a package of television channels, replay programmes, video-on-demand (VOD) content and exclusive programmes selected by MONDIAL TV.

All content offered is broadcast in accordance with broadcasting agreements and audiovisual rights licences concluded between MONDIAL TV and its partners or rights holders.
MONDIAL TV acts as an authorised broadcaster, guaranteeing its subscribers a legal service, compliant with the Intellectual Property Code, the Consumer Code and European directives relating to audiovisual media services.

The Service is operated and administered by MONDIAL TV SAS, which handles the technical, editorial and commercial management.

1.2 Nature of the subscription (channels, replay, VOD included)

The MONDIAL TV Subscription provides access, depending on the plan subscribed, to:

  • over 200 French and international channels, covering news, sports, cinema, music, children's, culture and entertainment;
  • replay programmes (catch-up television), generally available between 7 and 30 days after their initial broadcast, depending on the rights granted by the broadcasters;
  • a selection of video-on-demand (VOD) content included in the subscription, at no additional cost, subject to catalogue availability;
  • exclusive programmes produced or broadcast in partnership with MONDIAL TV.

The subscription is offered at a monthly rate of €9.90 incl. VAT, with no commitment, payable in advance. It includes automatic service updates and access to all new additions to the catalogue during the subscription period.

1.3 Supported devices and broadcasting areas

The MONDIAL TV Service is accessible from:

  • the official website https://mondial.tv (via any compatible browser),
  • the MONDIAL TV mobile application (Android and iOS),
  • compatible Smart TVs (Android TV, Fire TV, or equivalent),
  • as well as any computer, tablet or connected device with a stable Internet connection.

Use of the Service requires a minimum speed of 5 Mb/s for SD and 10 Mb/s for HD. For an optimal experience, a fibre, 5 GHz Wi-Fi or Ethernet connection is recommended.

Access to the Service is restricted to territories in which MONDIAL TV holds broadcasting rights.
Certain channels or programmes may be temporarily unavailable in certain regions for legal or technical reasons related to licences.

The Subscriber may use their account on a maximum of five (5) different devices, but simultaneous playback is limited in accordance with the security and licensing rules established by MONDIAL TV.

1.4 Mondial TV Stick – optional purchase (€49 incl. VAT, subject to availability)

MONDIAL TV offers, as an option and without obligation to purchase, a hardware device called "Mondial TV Stick" (or equivalent). This device allows access to the service directly on a compatible television via an HDMI port.

  • The retail price of the Mondial TV Stick is set at €49 including VAT, subject to availability.
  • The Mondial TV Stick is a complementary product: its sale is independent of the monthly subscription and does not condition access.
  • No lending, rental, or free provision of equipment is henceforth planned.
  • The equipment sold is new, guaranteed for 12 months, and delivered pre-configured for exclusive use with the MONDIAL TV service.
  • The TV Stick cannot be exchanged or refunded after activation or use of the Service.

The equipment remains the property of the Subscriber after purchase. MONDIAL TV is not responsible for the compatibility of the TV Stick with other external platforms or services.

ARTICLE 2 – CONDITIONS OF ACCESS AND USE

2.1 Account creation and security

To access the MONDIAL TV Service, the Subscriber must create a personal User Account via the official website https://mondial.tv or from the MONDIAL TV application available on Android and iOS stores.

Upon registration, the Subscriber agrees to provide accurate, complete and up-to-date information, including:

  • their last name and first name,
  • a valid email address,
  • and a payment method in accordance with the terms set out in Article 4.

Each Subscriber has a unique identifier (email) and a confidential password, personal and non-transferable. The Subscriber is solely responsible for the confidentiality and security of their credentials. Any connection or use of the Service made from their credentials shall be deemed to originate from them.

In case of loss, forgotten or fraudulent access, the Subscriber must immediately reset their password via the login interface or contact technical support at gestion@mondial-tv.fr. MONDIAL TV shall not be held liable for consequences related to unauthorised use of the account by a third party.

2.2 Minimum system requirements

Access to the Service requires a compatible device (computer, smartphone, tablet or Smart TV) and a stable high-speed Internet connection.

Minimum recommended configuration:

  • Computer: Windows 10 or macOS 10.12 or later; recent browsers (Chrome, Edge, Firefox, Safari).
  • Smartphone / Tablet: Android 8.0 or iOS 13.0 or later.
  • Smart TV / Android Box: Android TV 8.0 or later.
  • Internet connection: 5 Mb/s minimum for SD, 10 Mb/s for HD, 25 Mb/s for 4K.

The Subscriber acknowledges that the quality of the Service depends directly on the performance of their Internet connection and equipment. MONDIAL TV does not guarantee the compatibility of the Service with all existing or future equipment, browsers, operating systems or Internet service providers.

The costs of Internet connection or mobile data required to use the Service remain the sole responsibility of the Subscriber.

2.3 Personal use – up to 5 devices

The MONDIAL TV Subscription is strictly reserved for private and personal use, within the Subscriber's household. It is prohibited to use the Service in a collective, professional, commercial or public setting (e.g.: bar, hotel, public venue).

The Subscriber may connect their account on a maximum of five (5) different devices (smartphone, tablet, Smart TV, computer, etc.). However, to ensure compliance with broadcasting licences, the number of simultaneous connections is limited to one (1) active session at a time, unless otherwise specified in a particular offer.

MONDIAL TV reserves the right to analyse connections in order to detect any abnormal use (account sharing, multiple connections, inconsistent IP addresses, etc.). Any non-compliant use may result in temporary or permanent suspension of the account, in accordance with Article 2.5 and Article 11 of these T&C.

2.4 Access control and geo-restriction

For legal, technical and contractual reasons, MONDIAL TV applies geo-restriction measures designed to limit the broadcasting of certain content to areas authorised by rights holders.

Thus:

  • The Service is primarily accessible from mainland France and territories covered by applicable licences.
  • The use of a VPN, proxy, Smart DNS or any other geolocation bypass tool is strictly prohibited.
  • MONDIAL TV reserves the right to block or suspend access to any account using such devices.

Geolocation is carried out in compliance with the GDPR and solely for the purpose of ensuring compliance with broadcasting rights. In the event of temporary travel abroad, the Subscriber may access the Service only if broadcasting is authorised in the territory concerned.

2.5 Suspension for misuse

MONDIAL TV reserves the right to suspend, without notice, any account in the event of:

  • use contrary to these T&C;
  • unauthorised sharing of login credentials;
  • abnormal multiple simultaneous connections;
  • use of VPN or IP address masking tools;
  • attempted reproduction, recording, or public broadcasting of streams;
  • or more generally, any fraudulent, illegal activity or activity likely to undermine the security of the Service or the rights of rights holders.

In the event of suspension, the Subscriber is notified by email and invited to rectify their situation. In the absence of rectification within seven (7) days, MONDIAL TV may proceed with the permanent termination of the account, without refund of amounts already paid, in accordance with Article 11 hereof.

 

ARTICLE 3 – SUBSCRIPTION TERMS

3.1 Online or remote subscription

Subscription to the MONDIAL TV Service can be made:

  • via the official website https://mondial.tv ;
  • via the MONDIAL TV application available on official stores (Google Play Store, Apple App Store);
  • or by remote contact (telephone or email with an advisor).

During online subscription, the Subscriber follows these steps:

  1. Creation of the user account and entry of required information (identity, email, password, payment method).
  2. Validation of the order summary (chosen plan, price, terms).
  3. Express acceptance of these General Terms and Conditions of Use and Sale.
  4. Final validation by clicking the "Subscribe / Pay now" button.

This validation click constitutes an electronic signature within the meaning of Article 1367 of the Civil Code and entails full and complete acceptance of the contract. The Subscriber then receives a confirmation email summarising the details of their subscription, the amount billed and a link to these T&C downloadable on a durable medium.

MONDIAL TV reserves the right to refuse any subscription in the event of:

  • non-compliance of the information provided;
  • previous payment incident;
  • or fraudulent use of the service.
  •  

3.2 Off-premises subscription (field / canvassing)

In the context of a subscription made by a sales representative mandated by MONDIAL TV, face-to-face with the client (so-called "off-premises" sale), the procedure is governed by Articles L.221-1 et seq. of the Consumer Code.

The sales representative provides the Subscriber, before signing the contract:

  • a pre-contractual information sheet stating the essential characteristics of the service, its price, payment terms and the right of withdrawal;
  • a complete copy of the General Terms and Conditions of Use and Sale;
  • a detachable withdrawal form, in compliance with regulations.

The Subscriber must sign the contract manually or electronically, after having confirmed having read and accepted all conditions. A copy of the signed contract and information documents is immediately provided to the Subscriber on a durable medium (paper, email or PDF).

The contract is only fully effective after validation and activation of the subscription by MONDIAL TV.

No payment may be required before the expiry of the legal withdrawal period of 14 days, unless the Subscriber expressly requests immediate performance of the service, in accordance with Article L.221-25 of the Consumer Code.

3.3 Contract confirmation on durable medium

Regardless of the subscription method (online, remote or field), MONDIAL TV provides each Subscriber, at the time of conclusion of the contract, with a confirmation on a durable medium, including:

  • a detailed order summary (chosen plan, price, duration, service start date);
  • these General Terms and Conditions of Use and Sale;
  • the full contact details of the customer service and the withdrawal terms.

This document is automatically sent by email or provided on paper at the time of signing. It constitutes the contractual proof of the agreement between the Subscriber and MONDIAL TV.

The Subscriber is required to keep this document and verify the accuracy of the information it contains. In the event of an error, they must immediately inform customer service at gestion@mondial-tv.fr.

3.4 Subscription effective date

The subscription takes effect:

  • immediately after payment validation for online or application subscriptions, unless expressly requested otherwise by the Subscriber;
  • or at the time of account activation by MONDIAL TV for contracts signed off-premises (field or telesales).

In all cases, the Service is provided upon account validation, and the Subscriber receives a confirmation email containing the login information and the effective start date of their subscription.

Access is granted for a period of one (1) month, automatically renewable by tacit renewal, in accordance with Article 6 hereof.

In the case of a subscription with a promotional offer or free trial period, the effective date corresponds to the first day of actual access to the content.

ARTICLE 4 – PRICING, BILLING AND PAYMENT

4.1 Service price: €9.90 incl. VAT/month with no commitment

The MONDIAL TV Service is offered at a monthly price of €9.90 incl. VAT (all taxes included), at the rate in effect on the date of subscription. This price includes:

  • access to the channel package included in the offer,
  • replay and video-on-demand (VOD) features integrated into the service,
  • technical maintenance and application or WebTV updates.

The subscription is with no minimum commitment, automatically renewed each month by tacit renewal, unless cancelled by the Subscriber under the conditions set out in Article 6 hereof.

Any price change will be subject to prior notification in accordance with Article 4.5.

The price of the Mondial TV Stick is separate from the subscription and set at €49 incl. VAT, available as an optional purchase subject to stock availability.

4.2 Payment in advance (credit card, SEPA, App Store / Play Store)

The subscription price is payable monthly, in advance, at the time of subscription and then on each anniversary date.

Accepted payment methods are:

  • Credit card (Visa, MasterCard, CB) via the secure provider MOLLIE or any other DSP2-approved provider;
  • SEPA direct debit after electronically signed authorisation;
  • Payment via Google Play Store or Apple App Store platforms, subject to the conditions of these operators.

By validating their order, the Subscriber authorises MONDIAL TV to automatically debit the subscription amount at each due date. Payments are made on secure servers and no banking data is stored by MONDIAL TV.

The Subscriber guarantees to MONDIAL TV that they have the necessary authorisations to use the chosen payment method and that they will maintain sufficient funds or authorisations to enable payment at each due date.

4.3 Electronic billing

Each payment results in the issuance of an electronic invoice available in the Subscriber's client area. The Subscriber expressly accepts the receipt of their invoices in electronic format, in accordance with Article 289 VII of the General Tax Code.

Invoices indicate the period covered, the VAT-inclusive amount paid and the next due date.
In the case of subscription via a third-party platform (App Store or Play Store), billing is issued directly by said platform, under its responsibility.

4.4 Late or failed payment – suspension

In the event of a refusal or inability to process a payment, MONDIAL TV will send a notification email inviting the Subscriber to rectify their situation within a maximum of seven (7) calendar days.

Failing regularisation within this period:

  • access to the service may be temporarily suspended until full payment;
  • the Subscriber may be charged bank rejection or processing fees, in accordance with regulations, in the amount of 15 euros per rejection;
  • beyond thirty (30) days of non-payment, the contract may be terminated by operation of law, without prejudice to amounts owed to MONDIAL TV.

MONDIAL TV reserves the right to block any new subscription in the event of an unresolved unpaid balance.

4.5 Price revision and prior notice

MONDIAL TV reserves the right to modify its prices at any time, particularly in the event of changes in taxes, technical costs, or broadcasting rights.

Any price modification will be brought to the Subscriber's attention:

  • by electronic notification (email or message in the application);
  • at least fifteen (15) days before the effective date of the new rate.

The Subscriber will then have the option:

  • either accept the new rate, which constitutes continuation of the contract;
  • or cancel their subscription at no cost, before the new price takes effect, in accordance with Article 6.

Failing cancellation within the allotted period, the modification shall be deemed accepted and applicable from the following subscription period.

ARTICLE 5 – RIGHT OF WITHDRAWAL

5.1 14-day period

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Subscriber has a legal period of fourteen (14) calendar days from the date of subscription to exercise their right of withdrawal, without having to justify any reason or bear any penalty.

This period runs from:

  • from the date of conclusion of the contract, for an online or remote subscription;
  • or from the date of signing the contract, for an off-premises subscription (field or canvassing).

When the last day of the period falls on a Saturday, Sunday or public holiday, it is extended to the next business day.

5.2 Procedure (online, email, registered letter)

To exercise their right of withdrawal, the Subscriber may use one of the following options:

  1. Online

Log in to your account on the website https://mondial.tv, section "My account → Cancel / Withdraw", and submit the electronic form provided for this purpose.

  1. By email

Send a clear withdrawal request to gestion@mondial-tv.fr, indicating:

  • last name and first name,
  • email address associated with the account,
  • subscription date,
  • and explicit mention of the wish to withdraw ("I wish to exercise my right of withdrawal in accordance with Article L.221-18 of the Consumer Code").
  1. By registered letter with acknowledgement of receipt

Send the standard withdrawal form (provided in Annex 1 of these T&C) or a written statement to:

The request is deemed valid as long as it is sent before the expiry of the legal period of fourteen (14) days.

5.3 Specific terms for field / telesales (paper form)

In the context of an off-premises sale (field, canvassing) or telesales subscription, MONDIAL TV is required to provide the Subscriber with a paper or electronic withdrawal form, compliant with the official template of the Consumer Code.

This form can be:

  • signed and handed directly to the sales representative, or
  • returned by post or email to customer service within the legal period of fourteen (14) days.

No payment may be required before the expiry of the withdrawal period, unless the Subscriber expressly requests immediate access to the service, in accordance with Article L.221-25 of the Consumer Code.

If the Subscriber requests immediate performance of the service before the end of the withdrawal period and subsequently exercises this right, they will be liable for an amount proportional to the period of access actually used up to the date of withdrawal.

5.4 Effects: refund / account deactivation

When the right of withdrawal is exercised within the legal deadlines and conditions:

  • MONDIAL TV will deactivate access to the account and content upon receipt of the request;
  • any payment already made will be fully refunded within a maximum of fourteen (14) days from receipt of the withdrawal request.

The refund will be made using the same payment method used at the time of subscription, unless the Subscriber expressly agrees otherwise.

In the event of return of a Mondial TV Stick (if purchased), it must be:

  • returned in its new and complete condition (original packaging and accessories);
  • within a maximum of ten (10) calendar days from notification of the withdrawal;
  • to the customer service address mentioned above.

Return shipping costs are the responsibility of the Subscriber.

5.5 Exceptions: content already viewed, activated TV Stick

In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply in the following cases:

  1. Digital content already consumed: The Subscriber loses their right of withdrawal if they began viewing content of the Service before the end of the legal period, after having expressly given their consent to the immediate performance of the contract.
  2. Activated Mondial TV Stick: The right of withdrawal is excluded for the Mondial TV Stick once:
    • the product has been unpacked, activated or used;
    • or it contains software or digital licences already registered in the Subscriber's name.
  3. Promotional offers or free trials already consumed: If the Subscriber accessed the service under a free trial offer, withdrawal is only possible from the conversion to a paid subscription, provided that no content was consumed before that date.

 

ARTICLE 6 – DURATION, RENEWAL AND CANCELLATION

6.1 Monthly subscription without commitment

The MONDIAL TV Subscription is concluded for an initial period of one (1) month, from the service activation date as defined in Article 3.4. The subscription is with no minimum commitment, meaning the Subscriber may terminate it at any time, in accordance with the provisions of this article.

Payment of the subscription is made in advance, i.e. for the upcoming month, and covers the current billing period. No amount will be refunded for the current period, except in the event of a breach attributable to MONDIAL TV or the legal exercise of the right of withdrawal.

6.2 Automatic renewal

At the end of each monthly period, the subscription is automatically renewed by tacit renewal for an identical period of one (1) month, unless cancelled by either party under the conditions provided below.

The debit or automatic payment for the following month is made on the anniversary date of the subscription, unless previously cancelled. The Subscriber is informed of the tacit renewal at the time of subscription, in accordance with Article L.215-1 of the Consumer Code.

6.3 Cancellation initiated by the Subscriber

The Subscriber may cancel their subscription at any time, without justification or fees, by one of the following means:

  1. a) From their customer account
  • By logging into the personal area on the website https://mondial.tv.
  • By clicking on the "My account → Cancel my subscription" section.
  • By confirming the request via the validation button provided for this purpose.
  1. b) By email By sending a request to gestion@mondial-tv.fr, from the address associated with the account, specifying:
  • the account holder's last name and first name,
  • the email address linked to the account,
  • and the clear intent to cancel the subscription.

The Subscriber may, if they wish, notify their cancellation by registered letter with acknowledgement of receipt to:

The cancellation will take effect at the end of the current subscription period, provided the request is received at least 48 hours before the next billing date.

Any request received after this deadline will be taken into account for the following period.

A confirmation email is systematically sent to the Subscriber upon effective processing of the cancellation.

6.4 Cancellation by MONDIAL TV (fraud, non-payment, abuse)

MONDIAL TV reserves the right to terminate by operation of law, without notice or compensation, any subscription in the following cases:

  • Total or partial non-payment of one or more instalments despite reminders;
  • Fraudulent use or unauthorised sharing of credentials;
  • Abusive or illegal use, particularly in the case of public or commercial broadcasting of streams;
  • Circumvention of technical security measures, particularly the use of VPN, proxy or IP address masking tools to access unauthorised content;
  • Provision of false or incomplete information during subscription;
  • Conduct detrimental to the security, stability or reputation of the Service or its partners.

The termination is notified to the Subscriber by email. In this case, MONDIAL TV reserves the right to block any new subscription by the same user and to retain data necessary for fraud prevention, in accordance with applicable regulations.

Amounts already received for the current period remain acquired by MONDIAL TV.

6.5 Effects of cancellation

As of the effective date of cancellation:

  • access to the MONDIAL TV Service is immediately deactivated;
  • the Subscriber's login credentials are deactivated or deleted;
  • the Subscriber retains the ability to view their previous invoices from their client area for a period of thirty (30) days after deactivation;
  • no credit card data is stored by MONDIAL TV.

Account termination does not automatically result in the deletion of personal data, which is retained for the legally required duration for the administrative and accounting management of the contract, in accordance with the Privacy Policy and the GDPR.

MONDIAL TV undertakes to permanently delete all personal data at the Subscriber's express request, in accordance with Article 10 hereof.

ARTICLE 7 – AVAILABILITY, QUALITY AND SECURITY OF THE SERVICE

7.1 Continuity commitments

MONDIAL TV undertakes to implement all necessary technical, human and organisational means to ensure the continuous availability of the Service and the best possible broadcast quality.

The Service is available 24 hours a day, 7 days a week, except for scheduled maintenance or updates. Video streams are distributed via a secure and redundant infrastructure, designed to guarantee stable access to channels, replays and on-demand content, within the limits of the technical capacities of the Internet network and broadcasting agreements concluded with rights holders.

MONDIAL TV does not guarantee absolute availability of the Service, but undertakes to minimise any interruption.

The Subscriber expressly acknowledges that the quality of the Service also depends on:

  • of their Internet connection bandwidth,
  • the stability of their home network (Wi-Fi, 4G/5G, fibre, etc.),
  • and the performance level of their devices (television, smartphone, computer, etc.).

7.2 Planned interruptions or force majeure

MONDIAL TV may need to temporarily interrupt the Service to perform:

  • maintenance, improvement or system update operations;
  • modifications related to legal or contractual constraints imposed by rights holders or broadcasting partners;
  • or any other operation necessary for the proper functioning and security of the Service.

Whenever possible, Subscribers will be informed in advance of these planned interruptions by email, notification in the application or message on the official website.

MONDIAL TV shall not be held liable for temporary unavailability of the Service resulting from:

  • a case of force majeure within the meaning of Article 1218 of the Civil Code (natural disaster, fire, war, strike, widespread Internet failure, administrative decision, etc.);
  • a malfunction of the telecommunications network or Internet service provider of the Subscriber;
  • or a technical incident attributable to a third party involved in the broadcasting infrastructure.

However, in the event of a prolonged interruption of more than 72 consecutive hours attributable exclusively to MONDIAL TV, commercial compensation may be offered in the form of an access extension or equivalent credit, at the company's discretion.

7.3 Internet connection responsibility

The Subscriber is solely responsible for the installation, configuration and performance of their Internet connection and personal equipment used to access the Service.

It is their responsibility to:

  • to have a stable high-speed Internet connection (minimum 5 Mb/s for SD, 10 Mb/s for HD and 25 Mb/s for 4K);
  • to ensure the proper functioning of their Wi-Fi or Ethernet network;
  • to ensure that their security settings, firewalls or third-party software do not block the Service;
  • and to keep their devices and browsers up to date to ensure compatibility with the MONDIAL TV application.

MONDIAL TV disclaims all liability in the event of:

  • of slowness, disconnection, poor stream quality or inability to access the Service due to an Internet connection problem;
  • of use of the Service on a device or network not compliant with the technical specifications indicated in Article 2.2;
  • or of any failure resulting from an inadequate local configuration.

7.4 Anti-piracy protection

MONDIAL TV implements advanced protection measures designed to secure video streams and protect the intellectual property rights of its partners.

These measures include:

  • encryption of broadcast streams (DRM – Digital Rights Management);
  • access controls and authentication via unique credentials;
  • an automatic detection system for abnormal simultaneous connections or unauthorised account sharing;
  • and digital markers enabling the tracing of illegal use and combating unauthorised rebroadcasting of content.

Any attempt to circumvent these devices, record, capture, broadcast or reproduce all or part of the content is strictly prohibited and constitutes a violation of copyright and these T&C.

In the event of established piracy, fraudulent use or serious breach of these obligations:

  • MONDIAL TV may immediately suspend or terminate the account concerned, without notice or compensation;
  • and reserves the right to initiate any civil or criminal proceedings necessary to protect its interests and those of its rights holders.

ARTICLE 8 – LIABILITY

8.1 Limited liability of MONDIAL TV

MONDIAL TV is subject to a best-efforts obligation for the provision of the Service, in accordance with the practices of the audiovisual sector and the technical limitations of Internet networks.

MONDIAL TV's liability shall not be engaged in the event of:

  • technical malfunction, failure or temporary interruption of the Service resulting from maintenance operations, updates, network overload or causes beyond its control;
  • partial or total unavailability of certain channels or content, where this results from the end or suspension of broadcasting rights granted by rights holders;
  • failure of the Subscriber's Internet service provider or telecommunications network;
  • incompatibility of the Service with certain equipment, browsers or software versions;
  • indirect damages such as data loss, loss of opportunity, loss of profit or business disruption.

MONDIAL TV is in no way responsible for the content of the channels broadcast or for any programme errors, descriptions, subtitles or schedules, which are the sole responsibility of the partner broadcasters and publishers.

In any event, the total liability of MONDIAL TV, if it were to be engaged for any reason whatsoever, shall not exceed the total amount of sums actually paid by the Subscriber during the three (3) months preceding the occurrence of the damage.

8.2 Subscriber's liability (equipment, access, use)

The Subscriber is solely responsible for:

  • the installation and proper functioning of their computer equipment, television or connected device;
  • the security and confidentiality of their credentials and passwords;
  • the quality and stability of their Internet connection;
  • and any use of the Service made under their account, even without their knowledge, unless proven otherwise.

The Subscriber agrees to:

  • to use the Service exclusively for personal and private purposes, in compliance with French and international laws;
  • not to attempt to circumvent technical protection devices (encryption, DRM, access control);
  • not to share, redistribute, copy or record the broadcast streams of the Service, under penalty of immediate suspension and civil or criminal prosecution;
  • to promptly inform MONDIAL TV of any unauthorised or suspicious use of their account.

The Subscriber is liable for any damage caused to MONDIAL TV or third parties in the event of fraudulent or non-compliant use of the Service. In the event of a serious or repeated violation of these T&C, MONDIAL TV may proceed with immediate termination of the contract, without refund of amounts already paid, in accordance with Article 6.4.

8.3 Force majeure

In accordance with Article 1218 of the Civil Code, neither party shall be held liable for a breach of its contractual obligations in the event of a force majeure event beyond its reasonable control.

The following are notably considered cases of force majeure, without this list being exhaustive:

  • natural disasters, fires, explosions, floods;
  • large-scale power or telecommunications outages;
  • wars, terrorist attacks, riots, internal or external strikes;
  • global Internet failures or exceptionally large-scale cyberattacks;
  • governmental or administrative decisions or restrictions preventing programme broadcasting.

During the entire duration of the force majeure event, the parties' obligations are suspended.
If the situation persists beyond thirty (30) consecutive days, either party may terminate the contract without compensation, by simple written notification.

No compensation may be claimed from MONDIAL TV for a force majeure event.

ARTICLE 9 – CONTACTS / PERSONAL DATA

9.1 Ownership of rights

All elements comprising the MONDIAL TV Service – including, without limitation: the website, applications, graphic design, interfaces, logos, trademarks, texts, videos, sounds, images, databases, software tools and broadcast streams – are protected by the provisions of the Intellectual Property Code and remain the exclusive property of MONDIAL TV or its partners, publishers and rights holders.

The channels, programmes and content offered as part of the Service are broadcast in accordance with broadcasting licences and contractual agreements concluded with the relevant rights holders, producers, publishers and distributors. The Subscriber expressly acknowledges that MONDIAL TV acts as an authorised broadcaster and does not acquire any intellectual property rights over the content accessible via the Service.

No copyright assignment or reproduction rights are granted to the Subscriber under the subscription.

9.2 Personal and non-exclusive licence of use

MONDIAL TV grants the Subscriber a personal, non-exclusive, revocable and non-transferable licence to use the Service and its content, solely for private and domestic purposes, in compliance with these General Terms.

This license:

  • does not confer any ownership rights over the content, channels or associated software;
  • may only be used for viewing purposes via the official MONDIAL TV interfaces;
  • is limited to use on authorised devices and for the number of connections provided for in Article 2.3.

Any use of the Service in a public, commercial or collective setting (bars, hotels, waiting rooms, events, etc.) is strictly prohibited without the prior written authorisation of MONDIAL TV or its rights holders.

9.3 Prohibition of copying or rebroadcasting

The Subscriber is strictly prohibited, directly or indirectly, from:

  • reproducing, recording, copying, distributing, transmitting, publishing, adapting, modifying, translating, representing or broadcasting all or part of the Service or content accessible via MONDIAL TV;
  • capturing video or audio streams by any technical means (local recording, screen capture, stream duplication, etc.);
  • extracting or reusing data or elements of the Service in a repeated and systematic manner (databases, channel lists, descriptions, visuals);
  • using or sharing any software, code or device intended to circumvent the technical protection measures (DRM) implemented by MONDIAL TV;
  • offering, reselling, redistributing or making the Service accessible to third parties, whether free of charge or for a fee.

Any unauthorised reproduction or public broadcasting of programmes, even partial, constitutes counterfeiting within the meaning of Articles L.335-2 et seq. of the Intellectual Property Code and may give rise to civil and/or criminal proceedings.

9.4 Penalties for violation

Any breach of the obligations set out in this article exposes the Subscriber to:

  • immediate suspension of their access to the Service, without notice or refund;
  • definitive termination of the contract for serious fault, in accordance with Article 6.4;
  • and, where applicable, legal proceedings for copyright infringement, counterfeiting, computer fraud or violation of technical protection measures.

MONDIAL TV reserves the right to communicate any useful information to rights holders or competent authorities in the event of fraudulent or illegal use of the Service, in compliance with the GDPR.

In the event of proven damage (public rebroadcasting, account resale, illegal recordings, etc.), MONDIAL TV reserves the right to claim from the Subscriber damages proportionate to the harm suffered, as well as reimbursement of legal costs incurred.

ARTICLE 10 – PERSONAL DATA AND PRIVACY

10.1 GDPR-compliant processing

MONDIAL TV undertakes to ensure the protection, confidentiality and security of its Subscribers' personal data in accordance with:

  • Regulation (EU) 2016/679 of 27 April 2016 (GDPR),
  • French Law No. 78-17 of 6 January 1978, as amended, on data processing, files and individual liberties,
  • and the recommendations of the CNIL (French National Commission on Informatics and Liberty).

The data processing carried out by MONDIAL TV is intended for:

  • the creation, management and execution of the subscription contract,
  • secure billing and payment of services,
  • the provision and improvement of the OTT/IPTV Service,
  • customer relationship management and technical support,
  • and, subject to the Subscriber's explicit consent, the sending of commercial information or updates.

No personal data is used for purposes not provided for in these T&C.

10.2 Hosting and security

The personal data collected is hosted on secure servers located in Europe, in compliance with international security standards (ISO/IEC 27001).

MONDIAL TV implements all necessary technical and organisational measures to ensure the confidentiality, integrity and availability of data:

  • encrypted communications (HTTPS / SSL),
  • restricted access control to authorised personnel,
  • strong administrator authentication,
  • regular backups and business continuity procedures,
  • security audit and monitoring.

No banking data is stored on MONDIAL TV servers.
Payments are entirely managed by DSP2-approved providers (such as MOLLIE or SEPA EXPRESS).

In the event of a personal data breach posing a risk to users, MONDIAL TV will notify the CNIL and the persons concerned in accordance with Articles 33 and 34 of the GDPR.

10.3 Use, retention and duration

The data collected is strictly limited to what is necessary for the provision of the service.

They include in particular:

  • identification data (surname, first name, email, telephone);
  • contractual data (plan, subscription date, billing, payment history);
  • technical data (connected devices, connection logs, IP address, geolocation limited to broadcasting rights compliance);
  • and, where applicable, usage preferences (language, favourites, profiles).

Retention periods:

  • Account data: retained throughout the duration of the subscription, then deleted or anonymised within a maximum of 12 months after termination, subject to legal retention obligations (e.g.: accounting data).
  • Technical logs: retained for a maximum of 6 months for security and fraud prevention purposes.
  • Invoices and accounting records: archived for 10 years, in compliance with tax legislation.

Data is neither sold, rented, nor transferred to third parties for commercial purposes.
Any communication to a provider (host, customer support, technical maintenance) is subject to a subcontracting agreement in compliance with Article 28 of the GDPR.

10.4 User rights (access, rectification, erasure, portability)

In accordance with Articles 15 to 22 of the GDPR, every Subscriber has the following rights over their personal data:

  • Right of access: to obtain confirmation that data concerning them is being processed and receive a copy;
  • Right of rectification: to correct any inaccurate or incomplete information;
  • Right to erasure ("right to be forgotten"): to request the permanent deletion of data, subject to legal retention obligations;
  • Right to restriction of processing: to temporarily restrict the use of their data;
  • Right to data portability: to receive their data in a structured, readable and usable format;
  • Right to object: to object to any processing for commercial or statistical purposes;
  • Right to define the fate of their data after death, in accordance with the Data Protection Act.

The exercise of these rights is free and may be performed at any time in accordance with the terms set out in Article 10.5.

A response will be provided within a maximum of 30 days from receipt of the request, except in complex cases requiring an extension, of which the Subscriber will be informed.

In the event of a persistent disagreement, the Subscriber may refer to the CNIL (www.cnil.fr) for any complaint relating to the management of their personal data.

10.6 Cookies and trackers

The website https://mondial.tv and the MONDIAL TV application use cookies and similar technologies to:

  • enable the technical functioning of the service (authentication, security, session management);
  • improve the user experience (preferences, language, ergonomics);
  • produce anonymised audience statistics.

No third-party advertising cookies or commercial trackers are used without the explicit consent of the user. Upon first connection, the Subscriber may accept, refuse or customise their choices via the consent banner in compliance with CNIL recommendations.

Essential technical cookies are exempt from consent as they are necessary for the functioning of the Service.

ARTICLE 11 – SUSPENSION OR EARLY TERMINATION

11.1 Justified grounds for suspension

MONDIAL TV reserves the right to temporarily suspend the Subscriber's access to the Service, without notice, in the event of a breach of these General Terms, particularly in the following cases:

  • Non-payment or rejection of a billing instalment;
  • Fraudulent or abusive use of the account, particularly in the case of credential sharing, abnormal multiple connections or account resale;
  • Violation of intellectual property rights (unauthorised recording, broadcasting, reproduction of streams);
  • Circumvention of technical protection devices (DRM, geo-restriction, access limitation);
  • Use of VPN, proxy or any IP address masking device to access unauthorised content;
  • Conduct contrary to the law or likely to undermine the security, stability or reputation of the Service;
  • Attempted intrusion, alteration or disruption of the platform's operation.

Suspension of the Service does not entail immediate termination of the contract.
During the suspension period, amounts already paid remain acquired by MONDIAL TV.

A notification by email will be sent to the Subscriber, informing them of the reason for the suspension and the steps to be taken to rectify the situation.

11.2 Procedure and notification

Before any suspension or definitive termination, MONDIAL TV will send the Subscriber:

  • a prior warning by email stating the nature of the breach and a regularisation period of seven (7) calendar days;
  • except in cases of manifest fraud, piracy, or illegal activity requiring immediate action without notice.

If regularisation occurs within the allotted period, access to the Service will be restored at no additional cost.
Failing this, MONDIAL TV may proceed with automatic termination of the contract, without notice or compensation, while retaining the right to initiate legal proceedings in the event of harm.

Any suspension or termination decision is notified to the Subscriber by email to the address registered on their account, stating the reason and effective date.

11.3 Termination for serious breach

In the event of a serious breach of the Subscriber's contractual or legal obligations, MONDIAL TV may terminate the contract by operation of law without prior notice when:

  • the offence constitutes a breach of the Service's security (hacking, stream diversion, intrusion, fraud);
  • or when the Subscriber's conduct causes direct harm to MONDIAL TV, its partners or its rights holders.

This termination results in:

  • the immediate deletion of the user account,
  • the definitive deactivation of access to the Service,
  • and the loss of usage rights related to the subscription without possibility of refund.

MONDIAL TV may, where applicable, transmit to the competent authorities or relevant rights holders any information useful for establishing an offence and defending its interests.

The offending Subscriber remains liable for all amounts due as of the date of termination.

11.4 Subscriber's right in case of fault by MONDIAL TV

The Subscriber retains the right to terminate their contract by operation of law, without fees or penalties, in the following cases:

  • in the event of a serious or repeated breach by MONDIAL TV of its main obligations (service performance, non-compliance with contractual terms);
  • in the event of prolonged Service interruption exceeding seventy-two (72) consecutive hours attributable exclusively to MONDIAL TV;
  • or in the event of a substantial unilateral modification of the contract without prior information in accordance with Article 12 hereof.

To exercise this right, the Subscriber must notify their request by email to gestion@mondial-tv.fr, or by registered letter with acknowledgement of receipt addressed to customer service.

If the fault of MONDIAL TV is recognised and established, the termination takes effect on the date of receipt of the request, and the amounts received for the period subsequent to that date are refunded to the Subscriber within fourteen (14) days.

ARTICLE 12 – AMENDMENTS TO THE T&C

12.1 Amendment procedure

MONDIAL TV reserves the right to make modifications to these General Terms and Conditions of Use and Sale (T&C) at any time in order to:

  • comply with changes in applicable laws or regulations;
  • take into account technical, functional or editorial changes to the Service;
  • adapt commercial terms (prices, payment methods, features, etc.);
  • or integrate new complementary offers and services.

Any modification to the T&C shall apply only to subscriptions in progress from the announced effective date in the notification. Previous versions will remain available on the official website https://mondial.tv for archiving and transparency purposes.

12.2 Subscriber notification at least 15 days before application

In accordance with Article L.215-1 of the Consumer Code, MONDIAL TV will inform each Subscriber of any substantial modification to the T&C at least fifteen (15) days before their entry into force.

This information will be transmitted by email to the address associated with the Subscriber's account, and may also be published on the website or in the MONDIAL TV application.

The notification will clearly state:

  • the nature and scope of the modifications made,
  • the planned effective date,
  • and the right to cancel without penalty available to the Subscriber if they refuse the new terms.

Minor modifications that do not affect the Subscriber's essential rights or obligations (e.g.: typographical corrections, technical clarifications, contact details updates) may be made without specific notice, subject to their legal compliance.

12.3 Right to refuse and cancel without penalty

If the Subscriber does not accept the new terms, they may cancel their subscription without fees or penalties, by the following means:

  • by sending an email to gestion@mondial-tv.fr indicating their refusal of the new T&C;
  • or by proceeding with cancellation via their client area before the effective date of the modifications.

The cancellation will take effect at the end of the current subscription period. Amounts already paid for the current period will remain acquired by MONDIAL TV, unless otherwise decided in the case of a modification substantially affecting the provision of the Service.

The absence of cancellation before the application date of the new T&C constitutes tacit acceptance by the Subscriber. Accordingly, the new provisions will be fully enforceable against them from their entry into force.

ARTICLE 13 – CUSTOMER SERVICE AND COMPLAINTS

For any request for information, technical assistance, withdrawal or complaint, the Subscriber may contact the MONDIAL TV Customer Service by the following means:

    No technical assistance or complaints will be handled by telephone for traceability and security reasons.

13.2 Hours and response times

Customer service is available:

  • Monday to Friday, 10:00 AM to 6:00 PM (excluding public holidays).

Messages received by email or via the online form are processed within an average period of 24 to 48 business hours. Complex requests requiring technical or accounting analysis may be subject to an additional period, in which case the Subscriber will be informed by email.

13.3 Complaint procedure

In the event of dissatisfaction or dispute relating to the performance of the contract, the Subscriber may file a complaint with customer service:

  1. By sending an email to gestion@mondial-tv.fr, specifying:
    • their full contact details,
    • the email address associated with the MONDIAL TV account,
    • the subscription date,
    • and the specific subject of the complaint (billing, service, content, etc.);
  2. MONDIAL TV acknowledges receipt of the request and opens a follow-up file;
  3. A reasoned response is provided within a maximum of fifteen (15) working days from complete receipt of the complaint.

If no amicable solution has been found, the Subscriber retains the option of referring to an independent mediator in accordance with Article 13.4 below.

13.4 Consumer mediation

In accordance with Article L.612-1 of the Consumer Code, any consumer has the free right to resort to a consumer mediator for the amicable resolution of a dispute with MONDIAL TV, after exhaustion of internal complaint procedures.

The competent mediator for MONDIAL TV is:

Recourse to mediation is optional and does not suspend the legal deadlines for legal action.
The Subscriber remains free to accept or reject the solution proposed by the mediator.

ARTICLE 14 – APPLICABLE LAW AND DISPUTE RESOLUTION

14.1 French law

These General Terms and Conditions of Use and Sale are governed by French law, to the exclusion of any other legislation. They are drafted in the French language, which is the only authentic version in the event of translation.

The interpretation, validity, performance or termination of these T&C as well as any dispute relating to the MONDIAL TV Service fall within the exclusive jurisdiction of the French courts, subject to mandatory jurisdiction rules applicable to consumers.

14.2 Seeking an amicable solution

In the event of a dispute, the Subscriber agrees to first contact the MONDIAL TV Customer Service to seek an amicable solution.

The Customer Service will endeavour to resolve the dispute amicably within a reasonable time from receipt of the complete complaint.

Failing amicable agreement within thirty (30) days, the Subscriber may have free recourse to the consumer mediation procedure mentioned in Article 13.4, or to any other alternative dispute resolution method (conciliation, judicial mediation).

Recourse to mediation is optional and does not interrupt the time limits for legal action.

14.3 Competent court

Failing amicable resolution or successful mediation, any dispute relating to the validity, interpretation or performance of these T&C shall be submitted to the competent courts within the jurisdiction of the Créteil Court of Appeal, unless mandatory provisions to the contrary protect the consumer.

For Subscribers residing in the European Union, it is recalled that they also benefit from the rights guaranteed by Regulation (EU) No 1215/2012 of 12 December 2012 on jurisdiction and the recognition of judgments in civil and commercial matters.

 

Price Sheet

The MONDIAL TV+ service provided to the MEMBER is offered at a monthly price of €9.90 including VAT, in addition to administrative fees related to the opening of the contract.

The price of Audiovisual Programmes is available on the dedicated "On demand" pages on the Website and are indicated in euros including VAT.

The Company reserves the right to modify its prices at any time, but the Audiovisual Programmes will be billed based on the rates in effect at the time the order is recorded.

16.1 Payment methods

Payment for "On demand" Audiovisual Programme orders is made exclusively by one of the bank cards listed on the Website.

The User makes payment for their orders by providing their bank details. The transaction is secure. Payment is made on the secure banking servers of SEPA EXPRESS, a partner of the Company. The order is registered and validated upon acceptance of payment. Payment for "On demand" Audiovisual Programmes by bank card is immediate.

The User acknowledges and accepts that, for the purpose of facilitating their order and provided the User has created an account, the bank details initially provided at the time of registration may be used again securely to process their subsequent orders on the Website.

16.2 Video-on-demand content included in the service

The Subscription Video-on-demand content included in the service is unlimited, subject to payment of a monthly fee, to download and view, during any given month, all the Audiovisual Programmes belonging to the current month's selection listed on the Website.

The Audiovisual Programmes are available for download and viewing throughout the month with no limit on the number of viewings.

A single Audiovisual Programme may only be downloaded to one Receiving Device.

Mediation

In accordance with Article L. 612-1 of the Consumer Code, within one year of their written complaint, the consumer, subject to Article L.152-2 of the Consumer Code, has the right to initiate a request for amicable resolution through mediation, with
