Definition of terms used in the privacy policy

The following terms shall hereinafter be referred to as:

• "Personal Data" : is defined as " any information relating to an identified natural person or one who can be identified, directly or indirectly, by reference to an identification number or to one or more elements specific to them ", in accordance with the Data Protection Act of 6 January 1978.

• "Publisher" or "We" : Mondial TV, the legal or natural person responsible for the publication and content of the Service.
• "User" or "You" : the internet user visiting and using the Service.

Article 1 – Introduction and role of the Privacy Policy

This charter aims to inform you of the commitments of the Service with regard to respect for your privacy and the protection of Personal Data concerning you, collected and processed during your use of the Service.

It is important that you read this privacy policy so that you are aware of the reasons why we use your data and how we do so.

Article 2 – Data collected on the Website

The Data collected and subsequently processed by the Service is that which you voluntarily transmit to us by filling in the various forms present within the Service. For certain operations on the content, you may be required to transmit Data concerning you to third-party partners through their own services, particularly during payments you may make. We will not have access to said data, as their collection and processing are governed by the conditions specific to these providers. We invite you to consult their conditions before communicating your Data in this context.

The Service is not intended for persons under the age of 15. No voluntary collection of Personal Data is carried out on this audience.

Your IP address (identification number assigned on the Internet to your computer) is collected automatically. You are informed that the Service may implement an automatic tracking process (Cookie), which you can prevent by modifying the relevant settings of your internet browser, as explained in the general terms of this Service.

Generally speaking, it is possible for you to visit the Service https://www.mondial.tv without providing any personal information about yourself. In all cases, you are under no obligation to transmit this information. Nevertheless, in the event of refusal, you may not be able to benefit from certain information or services.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose. For the purpose of providing better content and services, the Service https://www.mondial.tv uses the Google Analytics analysis service. Google Analytics does not track your browsing habits on third-party services. The information about you that Google Analytics has access to does not contain any personal data about you.

The IP address collected via Google Analytics is anonymised before transmission to Google.

We do not collect so-called "sensitive" data.

The contact details of Service Users who have registered on it will be saved, in compliance with the provisions of the Data Protection Act of 6 January 1978. In accordance with this Act, they have the right of access, withdrawal, modification or rectification of the Data they have provided. The collection of Users' personal data by the Publisher does not require a declaration to the French data protection authority (the Commission Nationale de l'Informatique et des Libertés – CNIL).

Article 3 – Identity of the data controller

The data controller is the company Mondial TV, with its registered office at the following address: 14 – 16 Avenue Louison Bobet, 94120 Fontenay sous Bois.

No DPO "Data Protection Officer" has been designated as such.

Article 4 – Purpose of collected Data

Data identified as mandatory on the Service forms is necessary in order to benefit from the corresponding features of the Service, and more specifically from operations on the content offered within it.

The Service may collect and process User Data:

• For the purpose of providing you with the information or services you have subscribed to, including: Sending newsletters, commercial offers.
• For the purpose of gathering information to help us improve our Service, products and features (particularly through the use of cookies).
• For the purpose of being able to contact you regarding: promotional offers or customer services.

Article 5 – Recipients and use of collected Data

The Data collected by us is processed for the purposes of executing operations on the Service content.

You may receive emails from our Service, particularly in the context of newsletters you have accepted. You may request to stop receiving these emails by contacting us at contact@mondial-tv.fr or by clicking the link provided for this purpose in each email sent to you.

Only Mondial TV is the recipient of your Personal Information. This information is never transmitted to a third party, notwithstanding the subcontractors to which Mondial TV may have recourse. Neither Mondial TV nor its subcontractors market the personal data of visitors and users of its Service.

Your personal data may be shared with the parties indicated below for the purposes defined in this privacy policy.

We require all third parties to guarantee the security of your personal data and to process it in accordance with the law. We do not allow our third-party service providers to use your data.

Article 6 – Legal basis governing data processing

In accordance with the General Data Protection Regulation (GDPR), Mondial TV only processes personal data in the following situations:

• with your consent ;
• when there is a contractual obligation (a contract between Mondial TV and you);
• to respond to a legal obligation (under EU or national legislation).

Article 7 – Data Security

You are informed that your Data may be disclosed pursuant to a law, regulation or a decision of a competent regulatory or judicial authority, or if necessary, for the Publisher to preserve its rights and interests.

We have implemented appropriate security measures to prevent your personal data from being accidentally lost, used, modified, disclosed or accessed without authorisation. Furthermore, access to your personal data is subject to a defined and documented security procedure.

Article 8 – Data Retention Period

The Data is stored by the Service's host, whose contact details appear in the Service's legal notices, and is retained for the duration strictly necessary for the achievement of the purposes mentioned above, not exceeding 36 months. Beyond this period, it will be retained for exclusively statistical purposes and will not be used in any way.

Article 9 – Authorised providers and transfer to a country outside the European Union

Mondial TV informs you that it uses authorised providers to facilitate the collection and processing of data that you have communicated to us. These providers may be located outside the European Union and receive data collected through the various forms on the Service.

Mondial TV has previously ensured the implementation by its providers of adequate guarantees and compliance with strict conditions regarding confidentiality, use and data protection. In particular, attention has been paid to the existence of a legal basis for any transfer of data to a third country. To this end, some of our providers are subject to internal corporate rules (or "Binding Corporate Rules") which were approved by the CNIL in 2016, while others comply with Standard Contractual Clauses or standard contractual clauses approved by the European Commission.

Article 10 – Data protection rights

• The right to information: we are obliged to inform you of how we use your personal data (as described in this privacy policy).
• The right of access: it is your right to make a request for access to data concerning you in order to receive a copy of the personal data we hold; however, due to the obligation of security and confidentiality in the processing of personal data incumbent upon Mondial TV, you are informed that your request will be processed subject to you providing proof of your identity, particularly by producing a scan or photocopy of a valid identity document.
• The right of rectification: the right to ask us to rectify personal data concerning you that is incomplete or inaccurate. Under this right, the legislation authorises you to request the rectification, updating, blocking or deletion of data concerning you that may be inaccurate, erroneous, incomplete or obsolete.
• The right to erasure, also known as the "right to be forgotten": in certain cases, you may ask us to delete personal data we hold about you (unless there is a compelling legal reason that requires us to retain it).
• The right to restriction of processing: in certain cases, you have the right to ask us to suspend the processing of personal data,
• The right to data portability: you have the right to ask us for a copy of your personal data in a common format (for example a .csv file).
• The right to object: you have the right to object to the processing of your personal data (for example, by prohibiting us from processing your data for direct marketing purposes).

However, the exercise of this right is only possible in one of two situations: when the exercise of this right is based on legitimate grounds or when the exercise of this right aims to prevent the collected data from being used for commercial prospecting purposes.

You will not have to pay a fee for access to your personal data (or for the exercise of any other right). However, we may charge you a reasonable fee if your request is manifestly unfounded, repetitive or excessive. In such cases, we may also refuse to respond to your request.

Mondial TV shall be entitled, where applicable, to oppose manifestly abusive requests due to their systematic, repetitive nature, or their number.

We may ask you for specific information to confirm your identity and ensure your right of access to your personal data (or to exercise any other right). This is a security measure to ensure that personal data is not delivered to a person not authorised to receive it. We may also contact you for more information about your request, in order to give you a faster response.

We try to respond to all legitimate requests within one month. This one-month period may be exceeded if your request is particularly complex or if you have made several. In such cases, we will notify you and keep you informed.

Article 11 – Complaint to the Data Protection Authority

If you consider that Mondial TV does not comply with its obligations regarding your Personal Information, you may file a complaint or request with the competent authority. Article 12 – Cookie Policy

Upon your first use of the Service https://www.mondial.tv, you are informed by a banner that information relating to your browsing may be recorded in alphanumeric files called "cookies". Our cookie usage policy allows you to better understand the measures we implement regarding browsing on our Service.
